Personnel File Requests

Per Sec. 103.13, Stats., an employer must provide the personnel file to an employee or former employee. A few points on this:
–The penalty for violating the rule is up to $100 per violation. Each day of refusal is a separate violation.
–The employer only has to provide records that are “used or which have been used in determining that employee’s qualifications for employment, promotion, transfer, additional compensation, termination or other disciplinary action, and medical records.”
–Do not send any correspondence with your attorney or done in anticipate of litigation.
–Employers do not have to release records relating to the investigation of possible criminal offenses committed by that employee.
